These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the designmyinterior.co.uk website (“Website” or “Service”) and any of its related products and services (collectively, “Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and Design my Interior Limited (“Design my Interior Limited”, “we”, “us” or “our”). By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Website and Services. You acknowledge that this Agreement is a contract between you and Design my Interior Limited, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services.

Billing and payments

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. If, in our judgment, your purchase constitutes a high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We reserve the right to change products and product pricing at any time. We also reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

Third Party Fees

You may incur third party fees through use of the Service, such as fees charged by your Carrier for data usage. In addition, you may be subject to third party terms, through your use of the Service, such as your Carrier’s terms of service. You acknowledge and agree that you are solely responsible for all such fees incurred by you for use of the Service, and you agree to pay all such fees and abide by all such terms.

Sending Messages Through the Service

Users may message each other through the Service. You agree that your use of the Service will not include sending unsolicited marketing messages or broadcasts (i.e. spam) Design my Interior Limited will utilise any means possible to block spammers and abusers from using the Service. If you believe spam originated from the Service, please email us immediately at support@designmyinterior.co.uk

Users are reminded that the following conduct is not allowed on the Design my Interior messaging service and Site:

  • Threatening or verbally abusive language;
  • Obscene, profane, or defamatory language;
  • Posting of sexual innuendo, or deliberately disrupting discussions with repetitive messages, or spam.
  • Language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual orientation, age, region, disability, etc.
  • Hate speech of any kind
  • Uploading of inappropriate material.
  • Posting, distributing, or publishing any libellous, defamatory, obscene, pornographic, abusive, or otherwise illegal material.
  • Users may include links to other sites as relevant to their design, but those sites must meet the same guidelines.

You acknowledge that messages sent over the internet (including the Site) are not encrypted and are not secure. Despite efforts to protect your information (including Data), we cannot ensure or warrant the security of any information (including Data) you transmit to us. Design my Interior Limited does not guarantee any confidentiality with respect to user generated content (UGC) and you understand and agree that you are solely responsible for your own UGC and the consequences of posting or publishing it. You transmit all information (including Data) at your own risk.

Your Grant of a Licence to Your User Generated Content (UGC) to Design my Interior Limited

Any UGC you transmit or post on our Site shall be considered non-confidential and non-proprietary and we shall have no obligations with respect to such material. When you transmit, post or share UGC on our Site, you grant us and our assignees a worldwide, non-exclusive, royalty free transferable and sub-licensable licence to copy, disclose, modify, prepare derivative works of, distribute, incorporate and otherwise use (or not use, as the case may be) such UGC and all data, images, sounds, text and other things embodied therein for any and all non-commercial or commercial purposes (including but not limited to advertising, promotion and sale). We also have the right to disclose your identity to any third party who is claiming that any UGC posted or uploaded by you to our Site constitutes a violation of their Intellectual Property Rights, or of their right to privacy.

You warrant, represent and undertake to Design my Interior Limited that you have all necessary licences, rights, consents, and permissions which are required to enable Design my Interior Limited to use or display your UGC in the manner contemplated by the Licence.

Design my Interior Limited might publish images on our website and social media of the designs and rooms we have created for our clients.

Our Privacy Policy and Cookie Policy apply in full to your use of the Site and the Interactive Services and contain further information about Design my Interior Limited’s uses of your Data.

Accuracy of information

Occasionally there may be information on the Website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, availability, promotions and offers. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Website or Services is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information on the Website including, without limitation, pricing information, except as required by law. No specified update or refresh date applied on the Website should be taken to indicate that all information on the Website or Services has been modified or updated.

Optional services

House visits may be restricted to certain geographical areas.  Please check our Website for up-to-date information on eligibility.

We reserve the right to refuse an Appointment for any reason or no reason and to refund you in full or in part in those circumstances.

We will use reasonable endeavours to agree and book an Appointment with you at a time and on a date that is convenient to you, but we offer no guarantee.  In the event an Appointment is varied or cancelled at your request and, despite our reasonable efforts, we are unable to agree a new date and time, then you can receive a refund only if you cancel the service within 14 days of the Effective Date by notifying us via e-mail at support@designmyinterior.co.uk

If you select our Measuring Service, we measure your desired space(s) with a laser measure and provide to-scale floor-plans.  These measurements are for information purposes and guidance and we neither offer nor imply any warranty as to their accuracy and you should rely on your own due diligence. It will be your responsibility to review, ensure and verify the accuracy of such measurements to your own satisfaction.

We will endeavour to scale up floorplans provided by you or your contractor with reasonable accuracy. Design my Interior does however require you to check these floorplans are accurate and correct before beginning any form of design work such as hiring tradesmen, requesting quotes and purchasing furniture and other items.

Third party services

If you decide to enable, access or use third party services, be advised that your access and use of such other services are governed solely by the terms and conditions of such other services, and we do not endorse, are not responsible or liable for, and make no representations as to any aspect of such other services, including, without limitation, their content or the manner in which they handle data (including your data) or any interaction between you and the provider of such other services. You irrevocably waive any claim against Design my Interior Limited with respect to such other services. Design my Interior Limited is not liable for any damage or loss caused or alleged to be caused by or in connection with your enablement, access or use of any such other services, or your reliance on the privacy practices, data security processes or other policies of such other services. You may be required to register for or log into such other services on their respective platforms. By enabling any other services, you are expressly permitting Design my Interior Limited to disclose your data as necessary to facilitate the use or enablement of such other service.

Links to other resources

Although the Website and Services may link to other resources (such as websites, mobile applications, etc.), we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein. Some of the links on the Website may be “affiliate links”. This means if you click on the link and purchase an item, Design my Interior Limited will receive an affiliate commission. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their resources. We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties. You should carefully review the legal statements and other conditions of use of any resource which you access through a link on the Website and Services. Your linking to any other off-site resources is at your own risk.

Your use of any information on Design my Interior blog is entirely at your own risk. It is your responsibility to ensure that any tutorials or information available through this blog meet your specific requirements and skills. Design my Interior will not be held responsible for any form of issue caused by the advice provided.

Comments on this blog deemed to be spam, solely promotional in nature or offensive will be deleted. For this reason, all comments are moderated. We reserve the right to edit or delete any comments submitted to the blog without notice.

This Agreement does not transfer to you any intellectual property owned by Design my Interior Limited or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Design my Interior Limited. All trademarks, service marks, graphics and logos used in connection with the Website and Services, are trademarks or registered trademarks of Design my Interior Limited or its licensors. Other trademarks, service marks, graphics and logos used in connection with the Website and Services may be the trademarks of other third parties. Your use of the Website and Services grants you no right or license to reproduce or otherwise use any of Design my Interior Limited or third party trademarks.

Disclaimer of warranty

You agree that such Service is provided on an “as is” and “as available” basis and that your use of the Website and Services is solely at your own risk. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that the Services will meet your requirements, or that the Service will be uninterrupted, timely, secure, or error-free; nor do we make any warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through the Service or that defects in the Service will be corrected. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of Service is done at your own discretion and risk and that you will be solely responsible for any damage or loss of data that results from the download of such material and/or data. We make no warranty regarding any goods or services purchased or obtained through the Service or any transactions entered into through the Service unless stated otherwise. No advice or information, whether oral or written, obtained by you from us or through the Service shall create any warranty not expressly made herein.

Limitation of liability

To the fullest extent permitted by applicable law, in no event will Design my Interior Limited, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of Design my Interior Limited and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to an amount greater of one pound or any amounts actually paid in cash by you to Design my Interior Limited for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

The designer will obtain professional indemnity insurance for the duration of the project. The client agrees to have insurance to cover any damage to property, personal injury, death, loss or other damage, for the duration of the project. 

Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, failure of public or private telecommunications networks or non-performance by suppliers or sub-contractors.

If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms: we will contact you as soon as reasonably possible to notify you; and our obligations under these Terms will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Goods to you, we will arrange a new delivery date with you after the Event Outside Our Control is over. Where the Event Outside Our Control affects our performance of Services to you, we will restart the Services as soon as reasonably possible after the Event Outside Our Control is over. You may cancel the contract if an Event Outside Our Control takes place and you no longer wish us to provide the Goods and/or Services. We will only cancel the contract if the Event Outside Our Control continues for longer than 12 weeks.

Indemnification

You agree to indemnify and hold Design my Interior Limited and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website and Services or any willful misconduct on your part.

Severability

All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.

Dispute resolution

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of United Kingdom without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of United Kingdom. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in United Kingdom, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

Assignment

You may not assign, resell, sub-license or otherwise transfer or delegate any of your rights or obligations hereunder, in whole or in part, without our prior written consent, which consent shall be at our own sole discretion and without obligation; any such assignment or transfer shall be null and void. We are free to assign any of its rights or obligations hereunder, in whole or in part, to any third party as part of the sale of all or substantially all of its assets or stock or as part of a merger.

If there is a problem with the services

In the unlikely event that you are not satisfied with the standard of the Services, please contact us and tell us as soon as reasonably possible and give us a reasonable opportunity to remedy any issues. You will not have to pay for us to remedy any issues that were within the scope of our initial agreement. If however you have additional or different requirements from the original instructions, we will assess the changes required and give you a free quotation for any additional goods and services.

 

Refund policy

Our policy for our online Interior Design services is valid for a period of 14 calendar days from the date of the purchase. If you are not satisfied with the service for any reason you can ask for a refund. A pro-rated refund will be issued for the unused portion of the services. If the period of 14 days has lapsed since the purchase, we can’t, unfortunately, offer you a refund.

Refund requirements

The following criteria must be met to qualify for a refund:

  • Service must not be used. We consider the Service used from the moment the client creates an account in our online platform.

If the conditions listed above are not met, we reserve the right not to issue a full refund. In that case, we will issue a refund only for the part of the work that hasn’t been implemented.

Changes and amendments

We reserve the right to modify this Agreement or its terms relating to the Website and Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do, we will revise the updated date at the bottom of this page. Continued use of the Website and Services after any such changes shall constitute your consent to such changes.

Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Website and Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Website and Services.

These Terms of Sale set out the terms and conditions on which Third Party Retailers supply goods and services to You (“You” and “Your“) through Design my Interior Limited (“DMI“, “we“, “us“, “our“)’s designmyinterior.co.uk website  (“Website” or “Service”) and/or through the Interactive Services.

Please read these Terms of Sale carefully and ensure that You understand them before You submit Your order to us. These Terms of Sale tell You who we are, how products and services will be provided to You, what to do if there is a problem and other important information. If You think that there is a mistake in these Terms of Sale, please contact us to discuss.

This Agreement is legally binding between you (“User”, “you” or “your”) and Design my Interior Limited (“Design my Interior Limited”, “we”, “us” or “our”). By buying the products we recommend, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms “User”, “you” or “your” shall refer to such entity.

Accuracy of information

The images of the Goods on our website and in our supplier’s catalogues or brochures which we may show you are for illustrative purposes only. We cannot guarantee that the pictures accurately reflect the colour or finish of the Goods. Your Goods may vary slightly from those images and we will make every effort to discuss any differences with you prior to ordering the Goods. Because many of the Goods are bespoke, all sizes, weights, capacities, dimensions and measurements indicated on our website or in catalogues or brochures may vary from the actual Goods.

It is the client’s responsibility to ensure that furniture, fabrics and colours that they have selected from the samples shown to them by the interior designer are correct. 

Fabrics may differ slightly from sample swatches, since there are often small colour variations between batches.

Made-to-measure goods

​We, or our suppliers, may make the Goods according to the measurements you provide us. If we do so, please make sure your measurements are correct and accurate. Unfortunately, we cannot accept the return of made-to-measure Goods if the reason for the return is because you provided us with incorrect measurements. However, this will not affect your legal rights as a consumer in relation to made-to-measure Goods that are faulty or not as described. 

Limitation of liability

Design my Interior Limited does not accept any responsibility or liability for any incorrect furniture ordered by you or a third party, or furniture that may be the wrong size, wrong colour or arrive damaged, whether or not ordered by us;.

Design my Interior Limited works on the assumption that all clients check the dimensions of the furniture pieces recommended to them before purchasing. 

Design my Interior Limited will not accept any liability or responsibility for furniture ordered by you that is not to your satisfaction or needs to be returned for any other reason. It is your responsibility to check any product ordered by Design my Interior Limited or by your to ensure that the products ordered will pass freely into the room of choice, that they will fit in that room, can be transported via any door, stairs and doorways, and there are no other issues that could add difficulties to delivery or frustrate delivery;

While Design my Interior Limited will reasonably endeavour to ensure that all retail product links provided to you in a Virtual Design Plan are current in order to assist with purchasing the products, there is no guarantee that the furniture or accessories recommended by Design my Interior Limited will be available for purchase at all or within a specific time frame defined by you in your brief to us. If prices are provided as part of the e-design recommendation, there is no guarantee that you will find the article at the same price when you seek to order it; and, we reserve the right to maintain commercial partnerships and affiliate relationships with these third party goods and services providers.

Important checks before ordering goods

Please note that all items delivered beyond the threshold of your home are carried out at your own risk. The following handy little check list will help to ensure that we conduct a successful delivery into your home.

  • ADEQUATE FLOOR PROTECTION – Please ensure you have placed adequate covering to protect your lovely flooring or carpets. Due to health and safety the delivery team cannot remove any clothing or footwear.
  • BREAKABLE OBJECTS – Knocks and falls sometimes happen so it’s always best to remove anything that might break, or get damaged along the delivery pathway before the team arrives.
  • ACCESS IN PROPERTY – There is nothing worse than having your products delivered just to find it doesn’t fit in or around your home.  Always look out for twisty passages, low doorways and dog-leg stairs. You also need to make sure that the delivery van can make it close enough to your home. Please speak to us beforehand if you’re not sure. 
  • FAILED DELIVERIES – Failed deliveries unfortunately might come with a cost depending on each supplier’s terms and conditions.  

Delivery of goods

Please note that timescales for delivery and delivery charges will vary depending on the availability of the Goods and the different retailers. We will contact you with an estimated delivery date. Occasionally our delivery to you may be affected either by busy seasons or by an Event Outside our Control.  In such cases, you will be promptly notified.

If we are not able to deliver the whole of the Order at one time due to operational reasons or shortage of stock, we may deliver the Order in instalments. We will not charge you extra delivery costs for this unless we have discussed this with you first. Each instalment shall constitute a separate contract governed by these Terms. If we are late delivering an instalment or one instalment is faulty, that will not entitle you to cancel any other instalment. You only own the Goods once we have received payment in full. 

Refunds

Your contract for Products is between You and the relevant Third-Party Retailer. If You wish to end a contract for Products You must contact us and we will speak to the Third-Party Retailer on Your behalf. However, Your rights in relation to ending the contract will depend on the terms of Your contract with them.

Nothing in these Terms of Sale will affect Your legal rights. Any undertakings, representations, warranties or statutory terms relating to the fitness and quality of Products are given by the relevant Third-Party Retailers to You, and not by Us to You. Your ultimate recourse in the event of any dispute over the quality or use of the Products is through the relevant Third-Party Retailer.

Just a few things you need to be aware of: most custom items and sale items are often non-refundable. All returns also need to be in their original packaging to be accepted back. If the retailer does not cover the cost of return shipping and handling, then unfortunately this has to be met by the customer.

Personal shopper service

Our free Personal Shopper service is provided by Design Pal Pro through their online platform. If you decide to enable, access or use their services, be advised that your access and use of such other services are governed solely by the terms and conditions of such other services. Severability

All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable.
